🚚 2. Operational & Service Execution Disclaimer
Our core business involves heavy lifting, packing, and long-haul transportation. Customers must acknowledge the following operational realities before engaging our services:
⏱️ Delivery Timeframes
All delivery dates and transit times provided in our quotations are estimates only. They are not legally binding guarantees. Delays can occur due to border checkpoints, RTO challans, traffic pile-ups, or vehicle breakdowns. We are not liable for hotel bills, flight tickets, or loss of income due to delayed truck arrivals.
🌧️ Act of God (Force Majeure)
We are completely absolved of any liability for damages, delays, or loss of cargo caused by natural disasters (floods, earthquakes, heavy rain), political riots, national highway strikes, sudden government curfews, or any other uncontrollable "Act of God".
🏢 Premises & Property Damage
While our labour is highly trained, navigating heavy furniture (like 4-door wardrobes or double-door fridges) through narrow Indian staircases or tight elevators carries risks. We are not liable for minor scratches to wall paint, floor tiles, or elevator doors occurring during the loading/unloading process.
📦 Customer-Packed Items
If you choose to pack your own cartons (especially containing fragile items like glass, crockery, or electronics) to save costs, Sona Packers and Movers accepts Zero Liability for the internal condition of those boxes upon arrival, even if the exterior box appears intact.
⚖️ 3. Limitation of Liability & Valuation
This is a crucial legal parameter regarding the financial value of the goods we transport:
- Uninsured Goods: If the client explicitly declines or opts out of purchasing Transit Insurance, the entire consignment moves solely at the Owner's Risk. In the event of a major accident, fire, or theft, the company’s maximum financial liability is strictly capped at a goodwill gesture of ₹1,000, irrespective of the item's market value.
- Mechanical Derangement: We are a logistics company, not electronics technicians. We take no responsibility if an electronic appliance (TV, Refrigerator, PC) fails to turn on at the destination, provided there is no external physical damage to the item or its packaging. Internal wire displacement due to road vibrations is beyond our control.
- Valuables Excluded: Our personnel are strictly prohibited from packing or transporting jewelry, cash, property documents, blank cheques, passports, and precious metals. If a customer hides these in a standard carton and they go missing, the company holds absolutely no legal or financial responsibility.
🤝 4. Third-Party Vendor & Fleet Disclaimer
To provide nationwide logistical coverage, Sona Packers and Movers may occasionally utilize third-party verified fleet owners, specialized car-carrier trucks, or local unloading unions (like Mathadi workers in Maharashtra). While we act as your primary point of contact and manager, the operational liability during transit may fall under the Carriage by Road Act, 2007. Any local union charges demanded forcefully by local goons/unions at the destination must be borne by the client, as these are illegal practices outside our control.
💰 5. Quotation, Pricing & GST Disclaimer
All verbal, WhatsApp, or preliminary email estimates are subject to physical survey verification. The final bill may vary from the estimate if:
- The actual volume of goods (number of boxes, furniture items) is higher than initially declared by the customer over the phone.
- The distance between the parking area and the flat entrance exceeds 50 meters, requiring a long-distance manual carry.
- Hoisting (lifting furniture via ropes from balconies) is required because items do not fit through the staircase.
- Tax Disclaimer: All baseline quotes are exclusive of 18% Goods and Services Tax (GST) and Toll/Border Taxes unless explicitly written as "All-Inclusive".
